Terms of Service

These Terms of Service ("Terms") govern your use of the Offrati mobile app, website, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. About Offrati

Offrati is a marketplace that connects people who need a service ("consumers") with independent businesses that provide it ("providers"). Offrati is not a party to any agreement between a consumer and a provider, does not perform the services, and does not employ providers. We provide the platform that helps you find and connect with each other.

2. Eligibility and accounts

• You must be able to form a legally binding contract to use the Service.
• You are responsible for the accuracy of the information you provide and for all activity under your account.
• Keep your login credentials secure and notify us of any unauthorised use.

3. How the Service works

You describe what you need; Offrati routes your request to matched providers, who may submit offers. Provider identity and contact details remain hidden until you accept an offer. When you accept, the chosen provider's contact information is revealed so you can arrange the service directly with them. Any agreement, payment, scheduling, and performance of the service is strictly between you and the provider.

4. Consumer responsibilities

• Provide accurate request details and communicate respectfully.
• Evaluate providers, their offers, and their suitability before engaging them.
• Agree terms (price, scope, timing) directly with the provider.

5. Provider responsibilities

• Provide accurate business information and hold any licences, permits, and insurance required to offer your services lawfully.
• Honour the offers you submit and deliver services professionally and lawfully.
• Comply with all applicable laws, including consumer-protection and tax obligations.

6. Provider subscriptions and fees

Using Offrati is free for consumers. Providers may be required to maintain a paid subscription to receive and respond to requests. Applicable prices, billing periods, and renewal terms are shown before you subscribe. Except where required by law, subscription fees are non-refundable.

7. No endorsement; independent providers

Providers are independent third parties. Offrati does not endorse, guarantee, or assume responsibility for any provider, their offers, their conduct, or the quality, safety, or legality of the services they provide. Ratings and badges are informational and do not constitute a warranty.

8. Prohibited conduct

• Do not use the Service for any unlawful, fraudulent, or harmful purpose.
• Do not attempt to circumvent, disrupt, or reverse-engineer the Service or its security.
• Do not misrepresent your identity, post false information, or harass other users.
• Do not scrape, harvest, or misuse other users' information.

9. Intellectual property

The Service, including its software, design, logos, and content, is owned by Offrati or its licensors and is protected by law. We grant you a limited, personal, non-transferable licence to use the Service in accordance with these Terms. All rights not expressly granted are reserved.

10. Third-party services

The Service relies on third parties (for example WhatsApp, and the Apple App Store and Google Play). Your use of those services is subject to their own terms and privacy policies, and we are not responsible for them.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any provider will meet your expectations.

12. Limitation of liability

To the fullest extent permitted by law, Offrati and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your dealings with a provider or consumer. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid to Offrati in the twelve months before the claim, or USD 100.

13. Indemnification

You agree to indemnify and hold Offrati harmless from any claims, damages, and expenses arising from your use of the Service, your violation of these Terms, or your dealings with another user.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that could harm Offrati or other users.

15. Governing law

These Terms are governed by the laws of the Republic of Lebanon, without regard to its conflict-of-laws rules, and the courts of Beirut, Lebanon will have jurisdiction, unless mandatory law in your country of residence provides otherwise.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, notify you in the app. Your continued use of the Service after changes take effect means you accept the updated Terms.
